1. Agreement to Terms

By accessing or using WVCardHub (“we,” “us,” or “our” — operating at wvcardhub.com), you agree to be bound by these Terms & Conditions. If you do not agree, do not use this site. We may update these Terms at any time; continued use after posting constitutes acceptance.

You must be at least 18 years old to use WVCardHub. By using this site, you represent that you are 18 or older. We do not knowingly collect or process information from anyone under 18 (COPPA compliance).

2. Platform Role & Section 230

WVCardHub is an interactive computer service under 47 U.S.C. § 230 (Communications Decency Act). We are a platform, not the publisher or speaker of user-generated content. We do not verify the accuracy of listings, reviews, or marketplace ads submitted by users, and we are not liable for third-party content posted on this site.

We reserve the right, but are not obligated, to remove content that violates these Terms, applicable law, or community standards.

3. Pro Subscription

WVCardHub offers a Pro subscription plan at $15.00/month (USD), billed monthly on a recurring basis. By subscribing you authorize us to charge your payment method automatically each billing cycle until you cancel.

• Auto-renewal disclosure: Your subscription renews automatically every 30 days at the rate in effect at renewal. You will be charged unless you cancel before the renewal date.
• How to cancel: Cancel any time from your Account > Subscription settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
• Refunds: All sales are final. We do not offer prorated refunds for unused subscription time.
• Price changes: We will notify you by email at least 30 days before any price increase. Continued use after the effective date constitutes acceptance of the new rate.
• Free trial (if offered): Any free trial converts automatically to a paid subscription at the end of the trial unless cancelled before the trial ends.

Pro features are provided “as is.” We may modify, add, or remove features at any time with reasonable notice.

4. Sellers Marketplace

4.1 Platform Is Not a Party to Transactions

WVCardHub provides a classifieds-style marketplace where eligible community members can post buy, sell, and trade listings. WVCardHub is not a party to any transaction between users. We do not process payments, hold funds, guarantee delivery, or provide buyer or seller protection. All transactions occur directly between the buyer and seller.

Before transacting with any seller or buyer, use good judgment. Meet in a public place when possible, use payment methods with buyer protection (e.g., PayPal Goods & Services), and review the seller's profile and community history.

4.2 Eligibility

Seller pages are available to users who hold an active Pro subscription or have been granted Verified Seller status by a WVCardHub administrator. Eligibility may be revoked at our discretion for Terms violations.

4.3 Prohibited Listings

You may not post listings for:

• Counterfeit, fake, proxy, or unauthorized reproduction cards
• Cards that have been altered, trimmed, or re-holdered to misrepresent their condition or grade
• Searched, resealed, or otherwise tampered sealed product
• Stolen property
• Any item whose sale is prohibited by applicable federal, state, or local law

Violation of these rules will result in immediate removal of your listings and may result in termination of your account.

4.4 Taxes

You are solely responsible for determining and remitting any sales, use, or income taxes applicable to your transactions. WVCardHub does not collect or remit taxes on your behalf.

4.5 Safe Trading Tips

• Verify card authenticity before payment — request detailed photos and ask questions.
• Use PayPal Goods & Services or a credit card for purchase protection.
• For high-value items, consider professional grading (PSA, BGS, CGC) before sale.
• Local meetups: choose public, well-lit locations such as card shops or malls.
• Trust your instincts — if a deal seems too good to be true, it probably is.

5. Verified Seller Badge

The “Verified Seller” badge is a community designation granted at the sole discretion of WVCardHub administrators to members who have demonstrated trustworthy trading practices within the WV card community. It is not an official certification, guarantee, bond, or endorsement by WVCardHub. The badge does not guarantee the authenticity of any listing or the outcome of any transaction. WVCardHub may grant or revoke the badge at any time without notice.

6. User Content

By submitting listings, reviews, photos, or other content (“User Content”) to WVCardHub, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content on the platform. You represent that you own or have the right to submit the content.

You may not submit content that is defamatory, fraudulent, obscene, harassing, or infringing on third-party intellectual property rights.

7. Intellectual Property & DMCA

We respect intellectual property rights. If you believe content on WVCardHub infringes your copyright, please send a DMCA takedown notice to our designated agent:

Your notice must include: identification of the copyrighted work; identification of the infringing material and its URL; your contact information; a statement of good faith belief that the use is unauthorized; a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.

We will process valid DMCA notices promptly. Counter-notices may be submitted to the same address. Repeat infringers will have their accounts terminated.

8. Prohibited Conduct

You agree not to:

• Provide false or misleading information in any listing or profile
• Harass, threaten, or abuse other users
• Scrape, crawl, or harvest site data without permission
• Attempt to circumvent any security or access control measure
• Use the platform to distribute spam, malware, or unsolicited communications
• Impersonate another person or entity

9. Account Termination

We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, fraudulent activity, or any other reason we deem appropriate. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including Sections 6, 7, 10, 11, and 12) will survive.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WVCARDHUB AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY TRANSACTION CONDUCTED THROUGH IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO WVCARDHUB IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitations on damages, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless WVCardHub and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your User Content; (c) any transaction you conduct through the Sellers Marketplace; or (d) your violation of these Terms or applicable law.

13. Dispute Resolution

Informal resolution first: Before filing any legal action, you agree to contact us at legal@wvcardhub.com and allow 30 days for us to attempt to resolve the dispute informally.

Governing law: These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the state or federal courts located in Kanawha County, West Virginia, and you consent to personal jurisdiction there.

Class action waiver: YOU AND WVCARDHUB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Any dispute that cannot be resolved informally shall be heard in small claims court or individual proceedings only.

14. Communications & Email (CAN-SPAM)

If you subscribe to our newsletter or enable email notifications, you consent to receiving periodic emails from WVCardHub. Every commercial email we send will include: a clear “unsubscribe” link that honors opt-outs within 10 business days, identification of the message as an advertisement where applicable, and our physical mailing address.

Transactional emails (account alerts, password resets) may be sent regardless of marketing opt-out status.

15. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any part of the platform at any time without liability. We will provide reasonable notice of material changes where practicable.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remainder will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and WVCardHub regarding your use of the platform and supersede all prior agreements.
